Colombian Peace. Protocols to move toward the Final Agreement

The signing of the protocols to enforce agreements on bilateral and definitive ceasefire and the end of hostilities as well as those related to the process of decommissioning of weapons, is a new and strong sign that the peace process in Colombia continues its ineluctable march toward the Final Agreement, despite the mad fire of the enemies of peace, who want to make it fail for capricious political reasons without any common sense and any sense of humanity.
They will not succeed against the national will. They won’t be able to succeed. Reconciliation advocated by millions of compatriots, flies higher than the few black flags that today evoke fascism.

Reconciliation requires from everyone involved in the conflict, truth and acknowledgment of responsibility in order to access to restorative justice, but apparently there are some players who prefer silence with the noise of war, the truth about the causes and those responsible for the conflict.
How hard is to finalize an agreement to build peace. Some want it for free; others try to mount legal traps to prevent guerrilla commanders to be involved in politics; furthermore, others want, through wiles, to get hold themselves alone of the resources for implementation and its destiny. The 2017 budget, for example, reduces social investment and does not seem to take into account the requirements of peace. There are also others pressing with times, but denying a minimal gesture as a contribution to reconciliation in Colombia.
Once the agreements are closed, the key is implementation, and this should see the maximum participation of citizens, because their role cannot be limited to the countersignature. These mechanisms will have the capacity and enforcement power and will consist of representatives of the parties and society as appropriate, as the Agenda says.

All this is possible, but legal certainty and legal development of agreements are required so they would not remain a dead letter or a delusion, leading to disappointment, as has happened with other commitments and other processes. Because what all this is about is throwing the bases to give way to the action of the primary constituent, i.e. the people.
We must implement safeguards and security mechanisms that have been agreed on the point about the end of conflict.
The protocols signed today involve bilateralism and apply to both sides.
It’s then beginning the planning and execution required to put into practice the monitoring and verification mechanism at all levels, the adoption of mechanisms on the ground, the functioning of areas and points, and the guidelines for the process of decommissioning of weapons. It should be taken into account, though, that substantial steps with regard to the deployment of the insurgency to areas and transitional village points of normalization, and the decommissioning of arms, are subject to the enforcement of the rules guaranteeing the legal, social and political safety of the insurgency. Therefore the Final Agreement must be countersigned and into effective development.

 

Making a synthesis of what has been signed we can say that the Protocols define precisely the bilateral commitments for the materialization in the field of CFHBD and the process of decommissioning of weapons, including the scope of the Monitoring and Verification Mechanism as well as of the Non Armed Policy Mission of the UN that form its International Component, as well as aspects related to logistics, supply, communications, transportation, etc., determining in detail the scope and extent of that mechanism, the responsibilities of its international component, such as the criteria of transparency, credibility and trust for the execution of the procedure.
Considering the fundamental importance that the population must have in the implementation of the Reached Agreement, the mechanism in the areas will have direct contact with each community involved, as well as with social and political organizations, and State institutions at local, regional and national level, in order to contribute to activities that are organized, providing information, assisting in the dissemination of reports to the public opinion and presenting proposals and suggestions.
With this same vision, we must point out that within the Transitory Zones and Areas for Normalization, is guaranteed the functioning of civil authorities as well as free access to any citizen and the media, without limitation, except in the camps where the bulk of the armed guerrilla units is to be concentrated. Speaking of the media, it would be important a proactive link on their part to support and encourage the achievement of peace.
According to the protocols, in a first phase the parties will select and named FARC members and Government members that will be trained and notified to integrate monitoring and verification mechanism, in order to allow them some time to engage prior to their deployment. The international component will receive from the parties the names of their chosen people for this mission.

When the time comes, the FARC and the Government will order to their own troops the bilateral and permanent Ceasefire and the end of Hostilities.
Hopeful in an early progress on the important issues that remain to agree at the Talks Table, and driven by the binding force of what has been agreed, we prepare from now to begin the long-awaited bilateral and permanent Ceasefire and the end of Hostilities, a flag hoisted by the FARC-EP from the very beginning of the peace process, thinking in favoring those suffering the pains of war. Consequently, guerrillas who should be part of the Mechanism for Monitoring and Verification are ready, the International component mandated by Resolution 2261of the Security Council of the UN has been formed, and we are ready for the deployment of local and regional bodies defined, all of which provides, thanks to the strenuous efforts of millions of Colombians, a progress perspective that allows, every day, to say that the goal of the final agreement is closer and closer.

We end these reflections by acknowledging the intense activity of construction of this agreement made within the framework of the technical sub-committee, both by the team of senior officers of the Armed Forces appointed by the Government, headed by General Javier Florez, and the team of guerrilla commanders nominated by the FARC-EP for this mission and led by Carlos Antonio Losada.
The joint effort in which both parties have shown a genuine desire for peace, shows that a new Colombia is possible, where arms, will and conscience of Public Forces can take the course of defending citizens’ interests and social justice, something our Padre Libertador longed and fought for.

Protocolos para avanzar hacia el Acuerdo Final

La firma de los protocolos para hacer efectivo los acuerdos de cese al fuego y hostilidades bilateral y definitivo, y los relacionados con el proceso de Dejación de armas, es una nueva y contundente señal, de que el proceso de paz de Colombia sigue su marcha ineluctable hacia el Acuerdo Final, pese al fuego enloquecido de los enemigos de la paz, que quieren hacerlo fracasar por razones políticas caprichosas, desprovistas de sentido común y todo sentimiento de humanidad.

No podrán contra la voluntad nacional. No podrán. La reconciliación enarbolada por millones de compatriotas, ondea más alto que las escazas banderas negras que hoy evocan al fascismo.

La reconciliación exige de todos los involucrados en el conflicto, verdad y reconocimiento de responsabilidades para acceder a la justicia restaurativa, pero por lo visto hay algunos protagonistas que prefieren silenciar con el ruido de la guerra, la verdad sobre las causas y los responsables del conflicto.

Qué duro resulta finiquitar un acuerdo para construir la paz. Unos la quieren gratis; otros intentan montar trampas jurídicas para impedir que los comandantes de la guerrilla participen en política; más allá otros quieren, a través de artimañas, acaparar, ellos solos, los recursos de la implementación y su destino; el presupuesto de 2017, por ejemplo, reduce la inversión social y pareciera no tener en cuenta los requerimientos de la paz; y también hay otros que apremian con los tiempos, pero niegan un gesto mínimo como aporte a la reconciliación de Colombia.

Cerrados los acuerdos, la clave está en la implementación, y ella debe darse con la máxima participación de la ciudadanía, porque su protagonismo no puede limitarse a la refrendación. Estos mecanismos tendrán capacidad y poder de ejecución y estarán conformados por representantes de las partes y de la sociedad según el caso”, como dice la Agenda.

Todo esto es posible, pero se requiere la seguridad jurídica y el desarrollo normativo de los acuerdos para que no queden como letra muerta o una vana ilusión, que desemboque en el desengaño, como ha ocurrido con otros compromisos y en otros procesos. Porque de lo que se trata es de dejar sentadas las bases para darle paso a la acción del constituyente primario que es el pueblo.

Hay que poner en marcha las garantías y mecanismos de seguridad que se han pactado sobre el punto de fin de conflicto.

Los protocolos que hoy se firman, en tanto implican bilateralidad, aplican para ambas partes.

Empieza, entonces, el planeamiento y ejecución necesarios para el despliegue del mecanismo de monitoreo y verificación en todos los niveles, la adopción de los mecanismos en el terreno, el funcionamiento de zonas y puntos, y los lineamientos para el proceso de la dejación de las armas. Se debe tomar en cuenta, eso sí, que los pasos sustanciales en lo que respecta al desplazamiento de la insurgencia hacia las zonas y puntos veredales transitorios de normalización, y la dejación de armas, están supeditados a la puesta en vigor de las normas que garanticen la seguridad jurídica, social y política de la insurgencia. Deberá en consecuencia estar refrendado y en efectivo desarrollo el  Acuerdo Final.

Haciendo una síntesis de lo firmado podemos decir que los Protocolos definen con precisión los compromisos bilaterales para la materialización en el terreno del CFHBD y del proceso de dejación de armas, incluyendo las funciones del Mecanismo de Monitoreo y Verificación y de la Misión Política No Armada de NNUU que conforma su Componente Internacional, así como los aspectos relacionados con logística, abastecimiento, comunicaciones, transporte, etc., determinando en detalle el ámbito de actuación y el alcance del mencionado mecanismo, las responsabilidades de su componente internacional, como los criterios de transparencia, credibilidad y confianza para la ejecución del procedimiento.

Considerando la importancia fundamental que debe tener la población en la implementación del Acuerdo Logrado, el mecanismo en las zonas tendrá contacto directo con cada comunidad implicada, con las organizaciones sociales y políticas, y con la institucionalidad del Estado a nivel local, regional y nacional, para que de conjunto contribuyan en las actividades que se desplieguen, aportando información, ayudando en la difusión de los informes a la opinión pública y presentando propuestas y sugerencias.

 

Con esta misma visión, debemos precisar, que dentro de las Zonas y puntos Transitorios de Normalización, se garantiza el funcionamiento de las autoridades civiles y el libre acceso de cualquier ciudadano y de los medios de comunicación, sin ninguna limitación, excepción hecha de los campamentos donde se encuentra el grueso de las unidades guerrilleras armadas. Y a propósito de los medios, importante sería su vinculación propositiva apoyando y alentando la conquista de la paz.

Según los protocolos, se capacitará y certificará en una primera fase a los integrantes de las FARC y del Gobierno seleccionados por las partes para integrar el mecanismo de monitoreo y verificación, que dispondrá de un tiempo para acoplarse previo a su despliegue. El componente internacional recibirá de las partes los nombres de sus elegidos para esta misión.

Llegado el momento, FARC y Gobierno ordenaran a sus propias tropas el Cese al Fuego y de Hostilidades bilateral y definitivo.

Esperanzados en un pronto avance sobre los importantes temas que restan por acordar en la Mesa de Diálogos, e impulsados por la fuerza vinculante de lo pactado, nos preparamos desde ya para poder dar inicio al tan anhelado Cese al Fuego y de Hostilidades Bilateral y Definitivo, bandera que enarbolamos las FARC-EP desde el mismo inicio del proceso de paz, pensando en el favorecimiento de quienes padecen los dolores de la guerra. En consecuencia, se encuentran listos los guerrilleros y guerrilleras que deben hacer parte del Mecanismo de Monitoreo y Verificación, se ha conformado el Componente Internacional del mecanismo mandatado por Resolución 2261 del Consejo de Seguridad de NNUU, y estamos prestos para el despliegue de las instancias locales y regionales definidas, todo lo cual configura, gracias al esfuerzo denodado de millones de colombianos y colombianas, una perspectiva de avance que permite decir que cada día la meta del acuerdo final se acerca más y más.

Cerramos estas reflexiones haciendo un reconocimiento a la intensa actividad de construcción de este acuerdo realizado en el marco de la subcomisión técnica, tanto por el equipo de altos oficiales de las Fuerzas Armadas designados por el Gobierno, en cabeza del General Javier Flórez, como por el equipo de comandantes guerrilleros designados por las FARC-EP para esta misión, liderados por Carlos Antonio Losada.

La labor conjunta en la que ambas partes han mostrado el deseo franco por alcanzar la paz, muestra que sí es posible una Colombia nueva en la que las armas, la voluntad y la conciencia de la Fuerza Pública, pueden tomar el rumbo de la defensa de los intereses ciudadanos y de la justicia social, por la que tanto clamó y luchó nuestro Padre Libertador.
